STEP NY Oct Event - Community Property: Traps & Opportunities

About this event

When couples move, marry, divorce or invest across borders, community property quickly becomes a tax minefield—or a planning goldmine. Join us to decode how community vs. common law rules collide on divorce and death, how choice-of-law can flip outcomes, and where local law helps (or hurts) cross-border couples. The panel will explore the interplay of these rules in the U.S., Brazil, and Spain.

The program will cover:

·         How community property laws differ across U.S. states and internationally, with a focus on Brazil and Spain, and why these differences matter for families with cross-border ties.

·         Key income, gift, and estate tax considerations for couples holding community property.

·         The impact of moving between jurisdictions on the classification and division of marital assets, and how choice-of-law issues can affect outcomes in divorce and inheritance.

·         Strategies for structuring ownership, titling, and agreements to optimize tax results and protect client interests across borders.

·         Practical guidance when advising international families and migratory spouses with assets in multiple jurisdictions.
