Planning and Tax Issues and Impact Investing Considerations for Cross-Border Exempt Organizations

Please join us for this presentation by Paul DePasquale and Glenn Fox, partners of Baker McKenzie, who will address cross border philanthropic planning and related ESG matters.
Today’s multi-national, ultra-high net worth families and their family offices dedicate a substantial amount of resources to philanthropic endeavors that have a global reach. Many of these families also have members who reside in various jurisdictions that have different outlooks and legal systems with respect to the operations of family charitable foundations. This requires the practitioner not only to be an expert with respect to their own jurisdiction’s treatment of non-profit organizations but also to be familiar with the treatment in other countries, as well as the various tax treaties that may impact this treatment. Adding to this complexity is the desire on the part of many family foundations to be appropriate stewards on impact investing and projects, which requires foundation managers and their advisors to address issues in the areas of “ESG” (Environment, Social, and Governance) when administering the foundation and to be wary of the different treatment of ESG issues from one country to another. This session will provide an introduction to the aforementioned issues.
Paul DePasquale is a Partner in Baker McKenzie’s Wealth Management and Tax Practice Groups. He represents individuals, family offices, and family-controlled and founder-backed businesses throughout the world. He advises on tax planning, transactions, family business governance, transition and succession planning, and litigation. He advises clients on various tax and related matters, including mergers and acquisitions, funds, joint ventures, financings, securities offerings, family business succession, cross-border trust matters, and non-profit matters. He is a STEP member.
Glenn Fox is a Partner of Baker McKenzie's Wealth Management and Tax Practice Groups in New York and a member of the firm’s Global Tax Wealth Management Steering Committee. He focuses his practice on domestic and international tax, estate planning, and tax-exempt organizations lawyer. He has extensive experience working with closely held businesses, families, and charitable organizations from the US and overseas. Glenn's practice focuses on the use of sophisticated wills, trusts, closely held entities, tax-exempt (charitable) entities, and non-charitable purpose trusts to enable clients to bequeath and gift assets with the imposition of the least amount of transfer and income taxes. He also has significant experience in dealing with foreign assets, foreign trusts, and US and international tax-exempt organizations. Glenn's tax exempt/not-for-profit practice includes all elements of establishing and operating US and non-US charitable organizations that do business in the US and abroad. Glenn is an ACTEC Fellow and a STEP member.
